Main types of international patenting

Patenting under the PCT system (Patent Cooperation Treaty)

The PCT Agreement is valid in almost 150 countries and has a number of significant advantages:

• priority is ensured almost all over the world in case of filing an application under the PCT procedure;
• after filing an international application, the applicant, as a rule, has 30 months to decide on the advisability of patenting in specific foreign countries;
• the work of patent offices in the national phase is greatly simplified by the international search report and written opinion on the PCT application;
• If the invention is found to be unpatentable following the international phase, the applicant can abandon the application and avoid the costs of local patent attorneys, translations of application materials, and national fees.

Patenting according to the national procedure

Used if it is necessary to register the result of intellectual activity in one or more specific countries. The application is submitted to the national patent office of the selected country.

European Patenting (European Patent Convention)

Available in 30+ European countries upon filing an application with the European Patent Office (EPO). The languages ​​used to submit documents are English, French or German.

Eurasian patenting (Eurasian Patent Convention)

The Eurasian Convention was signed by 9 countries of the Eurasian region: Azerbaijan, Armenia, Belarus, Kazakhstan, the Kyrgyz Republic, Russia, Tajikistan, Turkmenistan. Eurasian and European patents are issued exclusively for inventions and are valid in the countries participating in the relevant agreement.
